  1. COURSE DESCRIPTION

This course is designed to assist law students in acquiring a general knowledge of land titles, the registration process, the registrable liens and encumbrances, the various deeds and instruments of conveyance, as well as the legal remedies available to parties dealing on property. At the end of the term, the students are expected to have a working know-how of the basic principles, policies and remedies provided for under existing Philippine laws on public lands, ordinary and cadastral land registration and the doctrines and principles underlying the Torrens system.

Specifically, the course syllabus is devised and planned in such a way as to enable the students to:

  • understand the basic legal and constitutional concepts that underpin the Public Land Act and the Property Registration Decree;
  • appreciate the Torrens system of land registration in the Philippines and understand the role of key government agencies and other actors in the system;
  • acquire knowledge on specific areas of land registration laws, rules and regulations;
  • learn and apply legal remedies available for ordinary and cadastral land registration cases and cases involving land grants from the administrative agencies of government;
  • appreciate the linkage between national laws and local laws on land classification and conversion; and
  • acquire knowledge on specific property registration issues such as overlapping titling mandates among various agencies and the conundrum that they engender.
  1. COURSE AND LEARNING OUTCOMES

Upon completion of this course, the students must be able to:

  • demonstrate an understanding of the major laws governing the acquisition of ownership and registration of land titles, as well as the various rules and regulations pertaining to conveyance, transfer and recording of liens;
  • exhibit an understanding of the terminology, concepts, cases and principles in Land Titles and Deed;
  • examine issues and concerns on the effect of overlaps in land administration and government grants and discuss how they can best be addressed;
  • evaluate land titling and registration laws critically; and
  • know the application of the pertinent rules of civil procedure and the rules laid down in PD 1529 as they apply to property registration.

  1. COURSE REQUIREMENTS
  1. The student must regularly attend the class.
  2. Active participation in class discussion/oral recitation is required.
  3. Each student has to take and pass all formative (quizzes, written assignments, case digests, reports, etc.) and summative tests (midterm/final exams). Homework must be submitted the next meeting.
  1. GRADING SYSTEM

Rating periods. The students will be graded for two (2) periods within the semester (midterm and final rating periods) according to the following:

Final Grade. The students will be given their respective final grades based on their average grades (AGs) in the mid-grading period (1st half of the term) and in the final grading grade (2nd half). The midterm rating has a weight of 45% and the final grading period accounts for 55% of the final grade.
